These Terms & Conditions (“Terms”) govern your use of naomiartworks.co.za (the “website”) and your purchase of artworks, prints and services from Naomi Artworks(“we”, “us”, “our”). By using this website or placing an order, you agree to these Terms.
These artworks and services are sold by Naomi Artworks (Pty) Ltd, trading from 1 Holley Close, 30 Bentley Park, South Africa. Naomi Artworks (Pty) Ltd is not currently registered for VAT, so no VAT is added to your order. You can reach us by email at info@naomiartworks.co.za.
1. About us
Naomi Artworks creates and sells original contemporary artworks, premium prints and bespoke commissions, and offers art staging & rental services. We operate in Cape Town and Sandton, South Africa. You can reach us at info@naomiartworks.co.za.
2. Using this website
- You may browse and purchase for lawful purposes only.
- You agree not to misuse the website, attempt to gain unauthorised access, or disrupt its operation.
- All content on the website is provided in good faith; we may update or correct it at any time.
3. Products & pricing
- Prices are shown in South African Rand (ZAR). Naomi Artworks (Pty) Ltd is not currently registered for VAT, so no VAT is added at checkout.
- Original artworks are one-of-a-kind and sold as single stock, once sold, an original is no longer available.
- Prints are produced to order in the sizes/editions shown.
- We take care to display colours accurately, but screens vary and every piece is handmade, so slight variation between the image shown and the physical artwork is normal and not a defect.
- We reserve the right to correct any pricing errors before accepting your order.
4. Orders & acceptance
Submitting an order and payment is an offer to buy. A contract of sale forms only once we accept your order and payment has been confirmed. If we cannot fulfil an order (for example, an original has already sold), we will notify you and refund any payment in full.
5. Payment
Payments are processed securely by PayFast, a South African payment gateway. We do not receive or store your full card details. By paying you agree to PayFast’s terms in addition to ours. Your order is only fulfilled once PayFast confirms a completed payment.
6. Delivery, returns & refunds
Delivery is covered in our Shipping & Delivery Policy, and your rights to cancel, return and obtain a refund are set out in our Refund & Returns Policy. Both form part of these Terms.
7. Intellectual property
All artworks, images, designs and text on this website are the intellectual property of Naomi Artworks (or its licensors) and are protected by copyright. Buying an artwork or print transfers ownership of the physical item only, copyright and reproduction rights remain with the artist. You may not reproduce, resell as prints, or use any work commercially without written permission.
8. Commissions, staging & rental
Bespoke commissions and art staging & rental are provided under separate arrangements confirmed in writing (including scope, timelines, deposits and rental terms). Commissions require a 50% deposit before work begins; this deposit is non-refundable once work has started, and completed commissions cannot be returned. Art staging & rental is arranged on a monthly basis and governed by a separate rental agreement that sets out the rate, minimum period and care of the works.
9. Limitation of liability
To the maximum extent permitted by law, we are not liable for any indirect or consequential loss arising from the use of this website. Nothing in these Terms limits your rights under the Consumer Protection Act.
10. Governing law
These Terms are governed by the laws of the Republic of South Africa.
11. Changes to these Terms
We may update these Terms from time to time. The version published on this website at the time of your order applies.
